Terms of service

These terms cover Flat 99 website builds and hosting. By submitting an order or using the site, you agree to them. Questions: richard@gotrichard.com.

The service

Flat 99 builds a small-business website from your intake answers and uploads, hosts it on Cloudflare, and can wire a simple CRM backend and free email forwarding. Optional brand colors and a free change bot are part of the offer. Domain registration via Cloudflare Registrar is included only on the paid annual plan described below.

Plan terms (plain bullets)

• First 25 sites: year 1 free for build + hosting + CRM + full export + free email forwarding. No domain included. You may bring your own domain; we can help point it.
• After that (and renewals): $99/year includes a Cloudflare Registrar domain (registration/renewal with the plan), hosting, CRM backend, and free email forwarding.
• Renewals: paid plans renew annually at the then-current $99/yr rate unless we tell you otherwise before renewal. Free year-1 sites convert to the paid plan after year 1 if you want continued hosting/domain services from us.
• Free email forwarding: included on free year-1 and paid tiers.
• Promo codes (FLAT99-* style): one free build (no domain). Promo free builds do not consume the first-25 free-cap slots. Each code is one-time use.
• Export: full download/export stays open — we do not gatekeep your files behind a login or paywall for export.

Price comparison (“$1000 site for $99”)

Our punchy line compares Flat 99 to sites that often cost much more from traditional agencies. That comparison is illustrative, not a guarantee of any particular agency quote, market rate, or savings for your project.

Delivery timing (“24h”)

We aim to deliver within about 24 hours on business days after we receive a complete intake (required answers and usable collateral). Timing may slip if information, approvals, or files are missing, if domain/DNS waits on you or a third party, or if volume/outages intervene. We will communicate material delays.

Your content and publish permission

You must have the rights to everything you send us (copy, logos, photos, trademarks). At intake you must confirm we may publish your business name, brand, and provided copy on the site we build. You are responsible for the accuracy of that content and for complying with advertising and local business rules that apply to you.

No guarantee of rankings, sales, or results

We build and host a professional small-business site. We do not guarantee search rankings, traffic, leads, bookings, sales, reviews, or any business outcome. Marketing results depend on your offer, market, follow-up, and many factors outside our control.

Change bot

The free change bot lets you request reasonable tweaks (hours, phone, hero photo, simple colors, etc.). Requests queue for automation/manual review. Abuse, illegal content, or out-of-scope redesigns may be refused. Identify with the email and order id from your confirmation when asked.

Payments, domains, and cancellations

• Paid plan: $99/yr as quoted at order time for the included domain + hosting stack.
• Domain registration is only on the paid plan; free year-1 and promo builds do not include a new domain purchase from us.
• To cancel or request export/deletion, email richard@gotrichard.com. Domain renewals and DNS changes may need lead time.
• Fees already earned for completed build work are generally non-refundable except where required by law or we agree otherwise in writing.

Acceptable use

No illegal goods/services, malware, phishing, hate or harassment content, or infringement of others’ rights. We may refuse, suspend, or take down a site that violates this.

Hosting and availability

Hosting runs on Cloudflare’s edge network. We aim for solid uptime but do not promise uninterrupted service. Maintenance, upstream outages, or force majeure can affect availability.

Limitation of liability

To the fullest extent allowed by law, Flat 99 and Richard Shillington are not liable for lost profits, lost data, or indirect/consequential damages. Our total liability for a claim related to the service is limited to the amount you paid us for Flat 99 in the 12 months before the claim (or $99 if you paid nothing). Some states limit these disclaimers; if that applies to you, some parts may not apply.

Governing law

These terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law rules, except where your local mandatory consumer protections say otherwise. Venue for disputes is in Florida courts of competent jurisdiction, unless the law requires another forum.

Changes

We may update these terms. The date at the top will change when we do. Material changes for existing customers will be communicated when practical.
